Terms and conditions: key aspects
INFORMATION PURSUANT TO ART. 13 OF LEGISLATIVe DECREE 196/2003 Pursuant to art. 13 of Legislative Decree 30 June 2003, n. 196 (hereinafter referred to as the law), and in relation to the personal data concerning you and which will be the subject of processing, we inform you of the following: 1. PURPOSES OF DATA PROCESSING The processing is directed to the completion by the Anps of institutional functions by virtue of the statute and the constitutive act. In particular, the personal data released by the interested party are essential for the analysis and investigation activities aimed at obtaining financing. They will be used for the management of the contractual relationship as well as for the fulfillment of the legal obligations provided for in financial matters. It will also be possible to process data for credit protection, for statistical purposes, for market analysis and surveys, for the detection of the degree of customer satisfaction. 2. METHOD OF TREATMENT a) It is carried out through operations or complex operations indicated by art. 2 of the law; b) it is carried out with the aid of electronic or otherwise automated means; c) it is carried out by ANPS personnel and/or by personnel of companies or companies linked to it in dependence on mandate contracts or professional assignments or other subjects in any way in charge. 3. PROVISION OF DATA The provision of data is strictly necessary for the purpose of carrying out the activities referred to in point 1. 4. REFUSAL TO PROVIDE DATA Any refusal to provide personal data by the interested party makes it impossible to carry out the activities referred to in point 1. 5. COMMUNICATION OF DATA The personal data acquired may be communicated to the following subjects: a) to other companies in the cases and in the manner provided for by Legislative Decree 196/2003; b) to private subjects (companies or consultants) who have relationships with ANPS for the processing or cataloguing of said data or who are in charge of processing the practices relating to the subject to whom the data refer, on behalf of ANPS 6. DISSEMINATION OF DATA For the performance of the purposes referred to in point 1), the data may be disseminated throughout the national territory to subsidiaries or associated companies, banks and credit institutions, brokerage agencies, insurance companies, non-bank financial intermediaries, companies and enterprises, consultants and freelancers also in associated form. 7. TRANSFER OF DATA ABROAD Personal data are not normally subject to transfer abroad, except where a law expressly provides for it. 8. RIGHTS OF THE INTERESTED PARTY Art. 7 of the law gives the interested party the exercise of specific rights, including: - obtaining from the owner the confirmation or not of their personal data and their availability in an intelligible form; - having knowledge of the origin of the data, as well as the logic and purposes on which the processing is based; - obtaining (when permitted by law) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as the updating, rectification or, if there is interest, the integration of the data; - opposing, for legitimate reasons, the processing itself. 9. DATA CONTROLLERS AND DATA PROCESSORS The data controller is ANPS, in the person of its legal representative pro tempore. The data controller is the manager in charge of the administrative service of the owner. CONSENT TO THE PROCESSING OF COMMON OR SENSITIVE PERSONAL DATA Acquired the information provided by the Data Controller pursuant to art. 13 of Legislative Decree 196/2003 the interested party: - gives his consent to the processing of his personal and sensitive data for the purposes and in the manner indicated in the aforementioned information.
